Skyrexio Games Terms of Use

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to play the Games for personal, non-commercial use on devices you own or control, subject to these terms and to the terms of the platform you got the Game from.

2. Virtual items and purchases

• Coins, lives, boosters and other in-game items have no real-world monetary value, cannot be exchanged for money and cannot be transferred between players.
• Purchases are made through the App Store, Google Play or itch.io and are subject to their terms. Refunds are handled by these platforms under their policies, except where applicable law gives you other rights.
• Non-consumable purchases such as "Remove Ads" or "No Ads" can be restored on your devices through the Restore Purchases option or the platform account used for the purchase.

3. Advertising

Free versions of the Games show ads. Some rewards can be received by watching an optional ad. How ads use data is described in the Skyrexio Games Privacy Policy.

4. Acceptable use

Do not cheat, modify, reverse engineer or tamper with the Games or their purchase systems, and do not use them in a way that breaks the law or harms other players or the platforms.

5. Online play

Online matches in Badminton Arena are provided through Photon Realtime by Exit Games and, on iPhone and iPad, through Apple Game Center, which also provides leaderboards and achievements and is subject to Apple's terms for Game Center. Leaderboards and achievements in Gem Voyage on iPhone and iPad are provided through Apple Game Center and are subject to Apple's terms for Game Center. Online play may be temporarily unavailable, for example when the online service is busy; the game then offers a match against the computer. If your opponent's connection is lost for more than 5 seconds, the match ends and you win; if your own connection is lost, the match is not counted. Closing the game or switching away from it for more than 4 seconds during an online match counts as leaving it: the match is recorded as a loss (after closing, the next time you open the game). A match already decided by the score ends with that score. A match in which the game data from your opponent does not follow the rules of the game is not counted for either player, and so is a match that both players leave at almost the same moment or that could not start on both devices. If playing with others becomes restricted on your device during a match, the match ends and is not counted. If you do not serve within 8 seconds, the game serves for you. Online arena matches in Eat & Evolve are provided on iPhone through Apple Game Center: if a player leaves a match, a computer player takes their place, and if the player whose device hosts the match leaves, the match ends for everyone.

6. Changes and availability

We may update, change or stop offering a Game or any feature. We try to keep the Games available and bug-free, but we do not guarantee that they will always be available or free of errors.

7. Disclaimer and limitation of liability

The Games are provided "as is" and "as available". To the maximum extent permitted by law, Skyrexio is not liable for indirect, incidental or consequential damages arising from the use of the Games, and our total liability is limited to the amount you paid for the Game or in-game items in the 12 months before the claim. Nothing in these terms limits rights that cannot be limited under the law of your country.

8. Governing law

These terms are governed by the laws of the State of Delaware, USA, except where the law of your country of residence requires otherwise.

9. Apple App Store

If you downloaded a Game from the App Store, the Apple Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies. Apple is not responsible for the Games or their support.
